Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the website volumix.co (the "Site") and any products or services offered through it, including the Volumix software application ("Software") and the Faderbox hardware product ("Hardware"), collectively referred to as the "Services."

By accessing the Site, downloading the Software, or purchasing the Hardware, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

The Services are operated by Volumix, a sole proprietorship based in Florida, United States. For questions, contact us at [email protected].

2. Eligibility

You must be at least 18 years old to purchase the Hardware or create an account. By using the Services, you represent that you meet this requirement, or that you are using the Services under the supervision of a parent or legal guardian who has agreed to these Terms on your behalf.

3. The Software (Volumix App)

The Volumix application is free, source-available software released under the PolyForm Noncommercial License 1.0.0. The source code is publicly available on GitHub. You may use and modify the Software for noncommercial purposes in accordance with that license's terms.

The Software is provided "as is," without warranty of any kind. We make no guarantees about uptime, compatibility, or fitness for any particular purpose. Use of the Software is entirely at your own risk.

4. The Hardware (Faderbox)

The Faderbox is a custom-built USB-C hardware controller designed to work with the Volumix software. The Hardware design and assembly are proprietary; the open-source license that applies to the Software does not extend to the Hardware design.

Each Faderbox is built to order. After you place an order, we begin assembling your specific unit based on the configuration you selected. Build time is typically 1 to 2 weeks before shipping.

5. Orders, Pricing, and Payment

All prices on the Site are listed in US dollars (USD). Shipping costs are calculated separately at checkout and paid by the customer.

Payments are processed by Stripe. We do not store your payment card details. By placing an order, you authorize us to charge your selected payment method for the total purchase amount, including shipping and any applicable taxes.

We reserve the right to refuse or cancel any order for reasons including but not limited to: product availability, errors in product or pricing information, suspected fraud, or violation of these Terms. If we cancel an order, we will issue a full refund to your original payment method.

Prices, product specifications, and availability are subject to change without notice.

6. Shipping

We ship the Hardware worldwide. Shipping times depend on destination and selected shipping method. Once your order ships, we will provide tracking information by email.

The customer is responsible for any customs duties, taxes, or import fees imposed by their country. We are not responsible for delays caused by customs processing.

Risk of loss and title for the Hardware passes to you upon delivery to the carrier.

7. Warranty

We provide a 12-month limited warranty on the Hardware against manufacturing defects, starting from the date of delivery. During this period, we will repair or replace, at our discretion, any unit that fails due to manufacturing defects under normal use.

The warranty does not cover:

  • Damage caused by misuse, accident, modification, or unauthorized repair
  • Cosmetic wear (scratches, fading, etc.) from normal use
  • Damage from liquid exposure, drops, or improper power supplies
  • Issues caused by third-party software or hardware

To file a warranty claim, contact [email protected] with your order number and a description of the issue.

8. Returns and Refunds

Because each Faderbox is built to order, our return policy is detailed separately. See our Refund Policy for full details.

9. User Accounts

You may use the Site as a guest, or you may optionally create an account. If you create an account:

  • You are responsible for maintaining the confidentiality of your password
  • You are responsible for all activity that occurs under your account
  • You agree to notify us immediately of any unauthorized access
  • We may suspend or terminate accounts that violate these Terms

You may delete your account at any time by contacting [email protected]. Some information may be retained as required by law (e.g., tax records).

10. Acceptable Use

You agree not to:

  • Use the Services to advertise or sell goods and services not offered by us
  • Sell, transfer, or share your account with others
  • Attempt to gain unauthorized access to other accounts or our systems
  • Use automated tools (bots, scrapers) to interact with the Site
  • Harass other users or our staff
  • Impersonate another person or entity
  • Upload malicious code or attempt to disrupt the Services
  • Use the Services for any unlawful purpose

We reserve the right to terminate access to the Services for any user who violates these rules.

11. Intellectual Property

All content on the Site, including text, images, logos, and product designs (except where noted as open-source), is owned by Volumix and protected by copyright and other intellectual property laws.

The Volumix software is licensed under the PolyForm Noncommercial License 1.0.0 — see the GitHub repository for full license terms.

The Faderbox hardware design, including circuit board layouts and enclosure designs, is proprietary. You may not reproduce, sell, or distribute copies of the Hardware design.

12. Disclaimer of Warranties

Except for the express 12-month Hardware warranty described above, the Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that the Software will be compatible with all systems or configurations.

13. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid us for the product or service that is the subject of the claim.

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

14. Time Limit for Claims

Any claim or dispute arising out of or relating to these Terms or the Services must be brought within 24 months from the date of the transaction or event giving rise to the claim. Claims brought after this period are waived.

15. Indemnification

You agree to indemnify, defend, and hold harmless Volumix, its owner, and affiliates from any claims, damages, or expenses (including reasonable attorney fees) arising out of your violation of these Terms, your misuse of the Services, or your violation of any law or third-party rights.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect when changes were made. Continued use of the Services after changes constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you (for example, by posting a notice on the Site or sending an email).

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Volumix regarding the Services and supersede any prior agreements.
